22 Penalty for neglect to extend mains

If for ninety days after demand in writing made to the undertakers, and tender made of an agreement, signed by the requisite number of owners or occupiers, to take and pay for a supply of water for three years or more, the undertakers refuse or neglect to lay down the necessary pipes, and to provide a supply of water as provided in section twenty-one or in the special Act they shall forfeit to each of such owners and occupiers the sum of four dollars for every day during which they refuse or neglect to lay down such pipes or to provide such a supply of water.

The undertakers shall not be liable to any penalty for not laying down pipes if they are unable to obtain the necessary labour or materials, or for not supplying water if the want of supply arises from frost, unusual drought, or other unavoidable cause or accident.
