164 Prohibition against taking or possession of fish in the closed season

(1)

For the purposes of section 67(1) of the Act, the taking of fish of a species that is subject to a closed season referred to in regulation 163 from waters to which the closed season applies during the period specified as the closed season for that species of fish is prohibited.

(2)

For the purposes of section 67(1) of the Act, the possession of fish of a species that is subject to a closed season referred to in regulation 163 in, on or next to waters to which the closed season applies during the period specified as the closed season for that species of fish is prohibited.

Note

A failure to comply with a prohibition in this regulation is an offence under section 67(3) of the Act. A penalty of 100 penalty units or 6 months imprisonment or both applies.
