23.02 Striking out pleading
(1)
If a statement of claim, defence or reply or any part of a statement of claim, defence or reply—
(a)
does not disclose a cause of action or defence; or
(b)
is scandalous, frivolous or vexatious; or
(c)
may prejudice, embarrass or delay the fair hearing of the proceeding; or
(d)
is otherwise an abuse of the process of the Court—
the Court may order that the whole or part of the statement of claim, defence or reply be struck out or amended.
(2)
This Rule, with any necessary modification, applies where the defendant counterclaims or claims against a third party.
