24.03 Stay on non-payment of costs
If—
(a)
a proceeding is dismissed for want of prosecution and the plaintiff is liable to pay the costs of the defendant of the proceeding; and
(b)
the plaintiff, before paying those costs commences another proceeding for the same, or substantially the same, cause of action—
the Court may by order stay the proceeding until those costs are paid.
