25.01 Withdrawal of notice of defence
(1)
A party who has filed a notice of defence in a proceeding may withdraw the notice of defence at any time with the leave of the Court.
(2)
Despite paragraph (1), a party who has filed a notice of defence in a proceeding in which the monetary amount sought is less than the amount set out in section 102(1) of the Act may withdraw the notice of defence at any time without the leave of the Court.
