25.04 Notice of discontinuance or withdrawal
(1)
A discontinuance or withdrawal without the leave of the Court must be made by filing a notice stating the extent of the discontinuance or withdrawal.
(2)
When the discontinuance or withdrawal is with the consent of other parties the notice under paragraph (1) must be indorsed with the consent of each party who consents.
(3)
On the day the notice is filed a copy must be served on each other party.
