38ZH Hearings to be in private
(1)
A hearing of an access regime dispute is to be conducted in private.
(2)
However, a hearing or part of a hearing may be conducted in public if the parties to the dispute agree.
(3)
The chairperson of an independent panel that is conducting a hearing in private may give written directions as to the persons who may be present.
(4)
In giving a direction under subsection (3), the chairperson of an independent panel must have regard to the wishes of the parties to the dispute and the need for commercial confidentiality.
