60AA Power to serve infringement notice

A police officer may serve an infringement notice on any person that he or she has reason to believe has committed an offence against section 6, 17A, or 49F.

Note
Section 6 deals with persons who are in a public place and are directed to move on.
Section 17A deals with disorderly behaviour by a person in a public place.
Section 49F deals with a person who is on bail contravening a conduct condition to which the grant of bail is subject.

A police officer may serve an infringement notice on any person that he or she has reason to believe has committed an offence against the following sections—

A protective services officer may serve an infringement notice on any person who he or she has reason to believe has committed at or in the vicinity of a designated place an offence against—

S. 60AA (1AB)(b) amended by No. 7/2022 s. 29(4).
section 17(1)(c) or (1)(d) or section 38B(1), (2), (3) or (4)..

An infringement notice under subsection (1A) or (1AB)(b) must not be served on a person who is under 18 years of age at the time of the alleged offence.

A protective services officer may only exercise the power to serve an infringement notice under this section in relation to a person who was at or in the vicinity of a designated place at the time of the alleged offence.

An authorised officer within the meaning of the Fisheries Act 1995 may serve an infringement notice on a person who the authorised officer has reason to believe has committed an offence against section 49F while on bail in relation to an offence against the Fisheries Act 1995 or an associated offence within the meaning of that Act.

An offence referred to in subsection (1) or (1A) for which an infringement notice may be served is an infringement offence within the meaning of the Infringements Act 2006.
