38 Appointment of acting Chief Executive Officer
Subject to subsection (2), if the Chief Executive Officer is unable to perform the duties of the Chief Executive Officer, whether because of illness, absence or otherwise, the Board may appoint another person to act in the place of the Chief Executive Officer during the period of inability for a period not exceeding 6 months.
For any appointment that is more than 2 months, the Minister must approve—
the appointment; and
the terms and conditions of the appointment.
The Minister may approve an extension of the appointment under subsection (1) for a further period not exceeding 6 months.
While a person is acting as the Chief Executive Officer, the person has and may exercise all the powers, and has and must perform all the functions and duties, of the Chief Executive Officer.
