40 Removal and resignation of the Chief Executive Officer
(1)
The Minister or the Board may remove the Chief Executive Officer from office at any time.
(2)
If the Minister or the Board removes the Chief Executive Officer under subsection (1), the Board must—
(a)
give 12 weeks written notice; or
(b)
give a payment in lieu of written notice.
(3)
The Chief Executive Officer may resign by written notice, signed by the Chief Executive Officer and given to the Board.
