Victorian Gambling and Casino Control Commission Act 2011

A commissioner's office becomes vacant if he or she—

becomes bankrupt; or

is convicted in Victoria of an indictable offence or elsewhere of an offence that, if committed in Victoria, would be an indictable offence; or

is removed from office under subsection (2); or

resigns by notice in writing delivered to the Governor in Council.

The Governor in Council, on the recommendation of the Minister, may remove a commissioner from office if the commissioner—

has refused, neglected, or failed to carry out the functions or duties of office;

has engaged in misconduct in carrying out the functions, powers or duties of office.

If a commissioner is removed from office under subsection (2), the Minister must cause to be laid before each House of the Parliament a full statement of the grounds of the removal within 10 sitting days of that House after the removal.
