38 Final request to be made a certain time after first request and consulting assessment
A person's final request must be made—
subject to subsection (2), at least 9 days after the day on which the person made the first request; and
in any case, at least one day after the day on which the consulting assessment that assessed the person as eligible for access to voluntary assisted dying was completed.
Subsection (1)(a) does not apply if the co‑ordinating medical practitioner for the person considers that the person's death is likely to occur before the expiry of the time period specified in that subsection, and this is consistent with the prognosis of the consulting medical practitioner for the person set out in the consulting assessment report form.
