45 Power to serve an infringement notice

(1)

An enforcement officer may serve or cause to be served an infringement notice on any person whom the enforcement officer has reason to believe has committed an offence against section 32(1).

(2)

An offence referred to in subsection (1) for which an infringement notice may be served is an infringement offence within the meaning of the Infringements Act 2006.

(3)

In addition to and without limiting section 12 of the Infringements Act 2006, an infringement notice referred to in subsection (1) may be served by sending the infringement notice by post addressed to—

(a)

the responsible person (within the meaning of Part 6AA of the Road Safety Act 1986) in relation to the vehicle involved in the offence; or

(b)

the person nominated in a tolling nomination statement that has been made by an authorised tolling person and accepted by an enforcement official as an effective statement under Part 6AA of the Road Safety Act 1986.

(4)

An enforcement officer may cause to be served together with an infringement notice a notice containing information about the requirements arising under this Act in relation to the use of a vehicle in a toll zone.
