20 Restrictions on operation of regulated aircraft in the vicinity of marine mammals
A person who is operating a regulated aircraft must not approach a marine mammal from head on.
Penalty: 20 penalty units.
A person who is operating a regulated aircraft must not fly directly over or pass the shadow of the aircraft directly over a marine mammal.
Penalty: 20 penalty units.
A person who is operating a regulated aircraft must not land on water or taxi on water within the caution zone of a marine mammal.
Penalty: 20 penalty units.
A person operating a regulated aircraft capable of hovering must not cause or permit that aircraft to hover if the person is operating the regulated aircraft within a 500-metre radius of a marine mammal.
Penalty: 20 penalty units.
A person does not commit an offence under subregulation (1), (2), (3) or (4) if the regulated aircraft is being used—
to search for or rescue persons under the authority of Victoria Police; or
to patrol for sharks under the authority of Surf Life Saving Victoria; or
by a person acting in accordance with a permit or authorisation granted or issued under the Act; or
by a person attending an emergency within the meaning of the Emergency Management Act 2013.
A person does not commit an offence against subregulation (1), (2), (3) or (4) merely because it is necessary to operate the regulated aircraft in order to—
avoid damage or prevent further damage to person or property; or
allow the regulated aircraft to take off or land; or
comply with an Act or regulations relating to the operation of the regulated aircraft.
