22 Entering the water in the vicinity of whales
(1)
A person must not enter the water within 50 metres of a non-dolphin whale.
Penalty: 20 penalty units.
(2)
A person must not enter the water within 30 metres of a dolphin.
Penalty: 20 penalty units.
(3)
A person does not commit an offence against subregulation (1) or (2) if—
(a)
the person is an authorised officer acting in the course of the officer's duties or a person acting under the direction of an authorised officer; or
(b)
the person is acting in accordance with a permit or authorisation granted or issued under the Act.
