26 Dogs in the vicinity of marine mammals
A person who is in charge of a dog must not allow that dog to be within the caution zone of a seal.
Penalty: 20 penalty units.
A person who is in charge of a dog must not allow that dog to enter the water within the caution zone of a whale.
Penalty: 20 penalty units.
A person who is in charge of a dog must not allow that dog to be within 300 metres of a stranded whale.
Penalty: 20 penalty units.
A person does not commit an offence against subregulation (1) if—
it is necessary to allow the dog to be within the caution zone of a seal to enable the person to pass the seal; and
the dog is on a leash; and
the dog is not within 10 metres of the seal.
A person does not commit an offence against subregulation (1) if the dog is on a vessel.
A person does not commit an offence against subregulation (3) if—
it is necessary to allow the dog to be within 300 metres of a whale to enable the person to pass the whale; and
the dog is on a leash; and
the dog is not within 50 metres of the whale.
