25 Noise in the vicinity of marine mammals
(1)
A person within the caution zone of a marine mammal must not make or cause to be made any loud or sudden noise.
Penalty: 20 penalty units.
(2)
A person within the caution zone of a marine mammal must not play back or cause to be played back an underwater sound or a recording of any kind.
Penalty: 20 penalty units.
(3)
A person does not commit an offence against subregulation (1) or (2) if—
(a)
the person is acting in accordance with a permit or authorisation granted or issued under the Act; or
(b)
the person is an authorised officer acting in the course of the officer's duties or a person acting under the direction of an authorised officer.
