Worker Screening Act 2020

The Regulator must ensure that an internal review of a decision under section 92A or the determination of an application under section 92B following a decision to give the applicant a WWC exclusion is conducted by a person who—

did not make the original decision; and

to the extent practicable, was not substantially involved in the process of making the original decision; and

is employed in a position of equal or higher seniority than the position of the original decision-maker; and

is suitably qualified or experienced to deal with issues raised by the internal review or further application.

Subsection (1)(a), (b) and (c) do not apply if the original decision was made by the Regulator personally.
