172 Taking sandalwood

(1)

A person must not take sandalwood on Crown land or private land unless the person —

(a)

is engaged in clearing that does not involve the commission of an offence under the Environmental Protection Act 1986 section 51C; or

(b)

otherwise has lawful authority to take it.

Penalty for this subsection: a fine of $200 000.

(2)

For the purposes of subsection (1), a person does not have lawful authority to take sandalwood on private land by reason only of being —

(a)

an owner or occupier of the land; or

(b)

a person authorised by an owner or occupier of the land to take the sandalwood.
