176 Supplying flora
(1)
A person must not supply flora except under the authority of a licence.
Penalty for this subsection:
(a)
if the offence involves a critically endangered species — a fine of $500 000;
(b)
if the offence involves an endangered species — a fine of $400 000;
(c)
if the offence involves a vulnerable species — a fine of $300 000;
(d)
if the offence involves specially protected flora or sandalwood — a fine of $200 000;
(e)
in any other case — a fine of $50 000.
(2)
It is a defence to a charge of an offence under subsection (1) to prove that the person charged lawfully acquired the flora and supplied it as a gift.
