Biodiversity Conservation Act 2016

For inspection purposes a wildlife officer may do one or more of the following —

at any time enter licensed premises (including a dwelling);

at any time enter a place that is not a dwelling;

at any time enter a dwelling with the informed consent of an occupier of the dwelling;

enter a place in accordance with an entry warrant.

For the purposes of subsection (1)(c), an occupier gives informed consent if the occupier consents after being informed by the wildlife officer —

of the powers that the wildlife officer wants to exercise in respect of the dwelling; and

of the reason why the wildlife officer wants to exercise those powers; and

that the person can refuse to consent to the wildlife officer entering the dwelling.
