If under section 206 or in the exercise of powers under the CI Act, a wildlife officer seizes live fauna and, in the opinion of the wildlife officer, it is not practicable to keep the fauna, the wildlife officer may release the fauna into the wild.

The power in subsection (1) is not to be exercised in circumstances where the wildlife officer reasonably suspects that another person is entitled to possession of the fauna.
