Biodiversity Conservation Regulations 2018

A fauna importing licence authorises the holder of the licence to import —

live fauna; or

fauna products specified in CEO guidelines issued for the purposes of this regulation.

Without limiting any other provision of these regulations, the CEO may refuse to grant a fauna importing licence if the CEO considers that the species of fauna to which the application for a licence relates is likely to be a biosecurity risk to the State.

Without limiting any other provision of these regulations, the CEO may refuse to grant a fauna importing licence if the CEO is not satisfied that fauna to be imported under the licence has been, or will be, lawfully taken or possessed under a law of another State or a Territory.

Without limiting any other provision of these regulations, a fauna importing licence that relates to live fauna may include a condition that requires the fauna to be collected from the place of import into the State by a person who holds an appropriate licence to possess the fauna.

The importing of a fauna product that is not subject to the operation of subregulation (1) is authorised (and does not require a licence).
