34 Confidentiality — contractors

(1)

This section applies in respect of a contract with the Chemistry Centre for the provision of services to the Chemistry Centre and applies to —

(a)

a person with whom the Chemistry Centre has the contract;

(b)

a director or employee of a person referred to in paragraph (a); and

(c)

any other person who performs functions under or in fulfilment of the contract.

(2)

A person to whom this section applies must not, directly or indirectly, record, disclose or make use of any information obtained in the course of performing functions under or in fulfilment of the contract except —

(a)

for the purpose of performing functions under or in fulfilment of the contract;

(b)

as required under another written law;

(c)

with the written consent of the person to whom the information relates; or

(d)

in other prescribed circumstances.

Penalty: a fine of $10 000 or imprisonment for 12 months.

(3)

In this section —

director has the meaning given to that term in the Commonwealth Corporations Act 2001 section 9.
