169 Control of the right to vote
Subject to subsection (3), a person must not directly or indirectly control the exercise of the right to vote of a member.
Penalty for this subsection: a fine of $6 000, or imprisonment for 6 months, or both.
If a person controls the exercise of the right to vote of a member at a meeting of a co‑operative —
the vote of the member is invalid; and
if the person is a member, the vote of the person is invalid.
Nothing in this section prevents —
the exercise of a vote by means of a proxy or power of attorney; or
a director controlling the vote of a corporate member; or
an agreed purchaser controlling a member’s vote pending settlement.
