171 Effect of relevant share and voting interests on voting rights

(1)

Subject to subsection (3) and section 167(5), a member of a co‑operative cannot vote if another person, whether or not a member of the co‑operative, has a relevant interest in any share held by the member or in the right to vote of the member.

(2)

A member who cannot vote because of this section may apply to the Registrar to review the matter.

(3)

The Registrar may order that the member may vote if the Registrar is satisfied in the circumstances of the case that loss of the right to vote would be unjust or unreasonable, and the order of the Registrar has effect accordingly.
