70 How plan brought into operation
(1)
This section applies if, and only if, the retail licence of the supplier to whose customers a last resort supply plan applies —
(a)
has been cancelled under section 35; or
(b)
has expired and has not been renewed; or
(c)
has been surrendered.
(2)
If this section applies, the Authority may, by notice published in the Gazette, determine that the last resort supply plan comes into operation on a day specified in the notice.
(3)
An order under subsection (2) is to specify the name of the supplier to whose customers the last resort supply plan applies.
