17 Exemptions for holders of generation licence connecting to SWIS

(1)

The holder of a generation licence is exempt from the Electricity Industry Act 2004 section 7(2) in relation to a transmission system used solely to transport electricity between 2 or more of the following —

(a)

generating works to which the licence applies;

(b)

storage works that are connected to the SWIS at the same point as the generating works;

(c)

the SWIS.

(2)

The holder of a generation licence is exempt from the Electricity Industry Act 2004 section 7(3) in relation to a distribution system used solely to transport electricity between 2 or more of the following —

(a)

generating works to which the licence applies;

(b)

storage works that are connected to the SWIS at the same point as the generating works;

(c)

the SWIS.

The exemptions provided for in subclauses (1) and (2) are subject to the condition that the connection of the distribution or transmission system to the SWIS complies with the relevant technical rules, as amended from time to time, published under the Electricity Networks Access Code 2004 established under the Electricity Industry Act 2004 section 104(1).
