40 Reports by conciliator

(1)

The conciliator —

(a)

may make reports to the Director on the progress of the conciliation process; and

(b)

must make a final report on the result of that process.

(2)

A report made under subsection (1)(b) —

(a)

must include details of any agreement reached; and

(b)

if no agreement has been reached, may —

(i)

recommend that the Director should investigate the matter; or

(ii)

make no recommendation; or

(iii)

recommend that the Director should not investigate the matter,

and may not make any recommendation except one referred to in this paragraph.

(3)

The conciliator must give a copy of a report under subsection (1)(b) —

(a)

to the provider and the user or the person who made the complaint concerned; and

(b)

if the provider is a registered provider, to the provider’s registration board.

(4)

A copy must be given —

(a)

under subsection (3)(a), on the same day as the conciliator makes the report to the Director; and

(b)

under subsection (3)(b), within 30 days after that day.
