136 Council or authorised person may commence prosecution
A prosecution for an offence under this Act may be commenced by the Council or by a person authorised in writing by the Council to do so.
Subsection (1) does not limit the ability of a person to commence a prosecution for an offence if the person has authority at law to do so.
In a proceeding for an offence under this Act, unless evidence is given to the contrary, proof is not required —
that the prosecutor is authorised to commence the prosecution; or
that a signature on a prosecution notice is the signature of a person authorised to commence the prosecution.
In a proceeding for an offence under this Act an officer of the Council authorised by the Council may appear on behalf of the Council.
