Offence that is also breach of heritage agreement

In force

If a prosecution for an offence under this Act and an action for a breach of a heritage agreement arise out of the same conduct the Council may —

(a)

pursue either the prosecution or the action; or

(b)

pursue both the prosecution and the action in separate proceedings; or

(c)

pursue both the action and the prosecution in combined proceedings.
