46 Earliest Commission may determine application
The Commission must not determine an application for development approval under this Scheme before —
(a)
the earlier of —
(i)
the expiry of the period referred to in clause 37(3) within which the local government may make recommendations about the application; or
(ii)
receiving recommendations from the local government under clause 37(3);
and
(b)
the expiry of the following periods in respect of notice of the proposed development of land —
(i)
any period specified for the purposes of clause 41(1)(a) or (b);
(ii)
any period referred to in clause 41(1)(c) for the purposes of that paragraph.
