29 Written report of reportable incidents

(1)

The operator of a pipeline activity must submit a written report of a reportable incident in accordance with this regulation.

Penalty: a fine of $5 500.

(2)

It is a defence to a prosecution for an offence against subregulation (1) if the operator has a reasonable excuse.

(3)

The report —

(a)

must be submitted to the Minister as soon as practicable, and in any case —

(i)

within 3 days after the first occurrence of the reportable incident; or

(ii)

if the Minister specifies, within 3 days after the first occurrence of the reportable incident, another period within which the report must be submitted — within that period;

and

(b)

must specify —

(i)

all material facts and circumstances concerning the reportable incident that the operator knows or is able, by reasonable search or inquiry, to find out; and

(ii)

any action taken to avoid or mitigate any adverse environmental impacts of the reportable incident; and

(iii)

any action taken, or proposed to be taken, to prevent a similar reportable incident.
