Permit holder’s rights before permit amended, suspended or cancelled
14 Permit holder’s rights before permit amended, suspended or cancelled
Except as provided by subregulations (2) and (3), this regulation applies where the Minister proposes to exercise a power conferred by regulation 12 or 13.
This regulation does not apply to the proposed exercise of a power conferred by regulation 12 or 13 if the Minister is of the opinion that the exercise of the power is necessary to prevent loss of life or property or serious injury to persons or property.
This regulation does not apply to the proposed exercise of a power conferred by —
regulation 12 in the circumstances mentioned in subregulation (2)(a) or (g) of that regulation; or
regulation 13 in the circumstances mentioned in subregulation (2)(c)(i) of that regulation.
Where this regulation applies, the Minister is to notify the permit holder —
of the proposal; and
that the applicant has a right to be heard by, or to make written submissions to, the Minister before the Minister makes a decision to exercise the power.
Written submissions may be made by the permit holder, as mentioned in subregulation (4)(b), within such period after the applicant is given notice under that subregulation as is specified in the notice.
The Minister is to have regard to any submissions made by the permit holder under subregulation (5) before making the final decision.
