Prescribed circumstances where Minister may suspend or cancel a licence (Act Sch. 1 cl. 25)
27 Prescribed circumstances where Minister may suspend or cancel a licence (Act Sch. 1 cl. 25)
For the purpose of clause 25(2)(g) of Schedule 1 to the Act, the circumstances to which subregulation (2) applies are circumstances where the Minister may suspend or cancel a licence under clause 25(1) of that Schedule.
This subregulation applies to the circumstances that, in the opinion of the Minister, in making a decision to grant a licence to the licensee, the Minister has relied on information that the licensee supplied to the Minister —
that the licensee knew to be false or misleading in a material particular;
that was false in a material particular and was supplied with reckless disregard as to whether the information was false or misleading in a material particular; or
that omitted some information without which the information supplied was, to the licensee’s knowledge, misleading in a material particular.
