Where co-offenders' circumstances of offending differ significantly — particularly in role, duration, and motivation — the sentencing judge may impose the same sentence despite one offender being charged with a more serious offence carrying a higher maximum penalty. An inappropriately low sentence on a co-offender cannot justify reduction of the applicant's sentence to one that would itself be inappropriately low.
