Power to correct decision and require repayment
219 Power to correct decision and require repayment
If the director‑general decides a claim, and is later satisfied that the decision is incorrect, the director‑general may amend or reverse the decision.
A decision cannot be amended or reversed under this section more than 5 years after it is made.
Subsection (2) does not apply to a decision that was made on the basis of false or misleading information provided by a claimant or a person on behalf of the claimant.
If the director‑general amends or reverses a decision, the director‑general may, in writing, direct the claimant to repay an amount of compensation paid under this part.
An amount owing under a law may be recovered as a debt in a court of competent jurisdiction or the ACAT (see Legislation Act, s 177).
