74 Eligible overseas electors
An elector—
who is, for the Commonwealth Electoral Act, an eligible overseas elector; and
whose address, recorded on the Commonwealth roll when the elector became a person referred to in paragraph (a), was an address in an electorate; and
who has, for this Act, indicated an intention to reside, or resume residing, in the ACT after ceasing to be a person referred to in paragraph (a);
is, subject to subsection (4), an eligible overseas elector for this Act in relation to the electorate in which that address is located.
The commissioner shall annotate the roll for an electorate so as to indicate the name of each person who is an eligible overseas elector in relation to the electorate.
The commissioner shall cancel an annotation in relation to a person if—
the person ceases to be an eligible overseas elector for the Commonwealth Electoral Act; or
the person notifies the commissioner that they do not intend to reside, or to resume residing, in the ACT after ceasing to be an eligible overseas elector for the Commonwealth Electoral Act.
A person ceases to be an eligible overseas elector for this Act on the day the annotation in relation to the person is cancelled.
