76 Enrolment etc
In this section:
claim means a claim for enrolment or transfer of enrolment.
Except as otherwise provided by this Act, the name of a person shall not be added to a roll except under a claim.
A claim must be—
signed as required for an enrolment claim under the Commonwealth Electoral Act; and
given to the commissioner.
For how documents may be given, see the Legislation Act, pt 19.5.
The identity of the claimant must be verified in the same way as the identity of a claimant for an enrolment under the Commonwealth Electoral Act must be verified.
On a claim under subsection (2), the commissioner shall—
enrol the claimant, if satisfied that the claimant is entitled to be enrolled under the claim; or
reject the claim.
After making a decision about a claim under subsection (2), the commissioner shall give the claimant—
if the claim is accepted—written notice of the decision specifying the electorate in which the claimant is enrolled; or
if the claim is rejected—an internal review notice about the decision.
If Australia Post notifies the commissioner, in writing, that the delivery of a posted claim for enrolment or transfer of enrolment has been delayed by an industrial dispute and, apart from the dispute, would have been delivered to the commissioner before 6 pm on polling day for an election, the claim is taken to have been received by the commissioner before 6 pm on polling day for the election.
In this section:
Australia Post means the Australian Postal Corporation established under the Australian Postal Corporation Act 1989 (Cwlth), section 12.
