35 How may a privacy complaint be made?
A privacy complaint must—
be in writing; and
include the complainant’s name, address and telephone number; and
identify the respondent and include details about the act or practice the subject of the complaint.
Despite subsection (1) (a), a privacy complaint may be made orally to the information privacy commissioner if the commissioner is reasonably satisfied that exceptional circumstances justify the commissioner dealing with the complaint without it being in writing.
Example—exceptional circumstances
waiting until the privacy complaint is put in writing would make dealing with the complaint impossible or impractical
