55 Dispute about LTCS commissioner’s assessment

(1)

A participant in the LTCS scheme may, by written notice to the LTCS commissioner, dispute an assessment, or part of an assessment, made in relation to the participant’s treatment and care needs under part 5 (Treatment and care needs assessment).

Note Treatment and care needs, of a participant in the LTCS scheme—see s 9.

(2)

A notice under subsection (1) must be given to the LTCS commissioner within 28 days after the day the LTCS commissioner gives the participant a copy of the LTCS commissioner’s certificate of assessment under section 23 (5) (Assessment of participant’s treatment and care needs).

(3)

The LTCS commissioner may allow a notice under subsection (1) to be given orally.
