172 Requirement to tell buyer about pseudoephedrine sales record
The authorised person selling pseudoephedrine by retail sale, must tell the buyer the following:
the seller is required to make a record of the sale;
the buyer may refuse to provide information for the record but, if the buyer refuses, the seller must not sell pseudoephedrine to the buyer;
the record may be made available to the following people:
a police officer;
a public servant who is a member of the administrative unit to which the chief health officer belongs;
a Commonwealth or State public servant (however described) who is a member of an administrative unit (however described) that administers legislation about medicines;
Note State includes the Northern Territory (see Legislation Act, dict, pt 1).
anyone other than the seller who supplies pseudoephedrine to the public in Australia;
the Pharmacy Guild of Australia;
the buyer has the right to see the record and have any mistake corrected.
In this section:
police officer includes a member of a police force (however described) of a State.
