173 Required information for pseudoephedrine sales records

(1)

The following is the required information for a pseudoephedrine record:

(a)

the date of sale;

(b)

the brand name, form, strength and quantity of pseudoephedrine sold;

(c)

the buyer’s name and address;

(d)

a unique identification number for the buyer from—

(i)

a photo identification document produced to the seller by the buyer; or

(ii)

if the buyer does not produce a photo identification document—

(A)

the buyer’s birth certificate; or

(B)

an Australian or New Zealand seniors card for the buyer;

(e)

the kind of identification the buyer produces.

Example—unique identification number

a person’s driver licence number

(2)

In this section:

Australian student identification card means a card issued to a person who is a student at an Australian secondary or tertiary education institution to identify the person as a student at the institution.

birth certificate, for a person, means—

(a)

the person’s birth certificate, or a certified extract from the register about the person’s birth, under the Births, Deaths and Marriages Registration Act 1997; or

(b)

a document issued under a law of a State, an external Territory or New Zealand that corresponds to a birth certificate or extract mentioned in paragraph (a) if the document identifies the issuing jurisdiction and states its date of issue.

photo identification document, for a person, means any of the following documents for the person if it is current and contains the person’s photograph:

(a)

an Australian driver licence or external driver licence within the meaning of the Road Transport (Driver Licensing) Act 1999;

(b)

a passport, other than an Australian passport;

(c)

a proof of identity card;

(d)

an Australian student identification card.

proof of identity card means a proof of identity card issued under—

(a)

the Liquor Act 2010, section 210 (Proof of identity cards); or

(b)

the law of a State, an external territory or New Zealand.
