174 Failure to amend pseudoephedrine sales record

(1)

This section applies if the seller of pseudoephedrine does not amend a pseudoephedrine record in accordance with section 171 (e) (ii) (Authorisation conditions for retail sale of pseudoephedrine—Act, s 44 (1) (b) and (2) (b)).

(2)

The buyer may, in writing, apply to the chief health officer for a direction to the seller to make the amendment.

(3)

The application must give reasons why the buyer thinks the record is incorrect.

(4)

The chief health officer must—

(a)

give a copy of the application to the seller; and

(b)

ask the seller to—

(i)

make the amendment and tell the chief health officer; or

(ii)

if the seller is satisfied that the amendment should not be made—send written reasons to the chief health officer not later than 10 working days after the day the seller receives the application why the amendment should not be made.
