59 Failure to return tobacco licence
A licensee commits an offence if—
the commissioner varies the licensee’s licence; and
the commissioner gives the licensee notice of the variation; and
the licensee does not return the licence to the commissioner within 14 days after the day the licensee is given the notice.
Maximum penalty: 5 penalty units.
A licensee commits an offence if—
the ACAT suspends or cancels the licensee’s licence; and
the ACAT gives the licensee notice of the suspension or cancellation; and
the licensee does not return the licence to the commissioner within 14 days after the day the licensee is given the notice.
Maximum penalty: 5 penalty units.
An offence against this section is a strict liability offence.
