63 Tobacco retailing—offences
(1)
A person commits an offence if the person—
(a)
carries on tobacco retailing; and
(b)
is not the holder of a retail tobacconist’s licence.
Maximum penalty: 50 penalty units.
(2)
The holder of a retail tobacconist’s licence commits an offence if—
(a)
the holder carries on the business of selling smoking products at premises; and
(b)
the premises are not stated in the licence as premises that are to be used in relation to the business.
Maximum penalty: 50 penalty units.
(3)
An offence against subsection (2) is a strict liability offence.
