Broadcasting Services Act 1992

The ACCC may, by legislative instrument, make a Code setting out conditions that are to be complied with in relation to the provision of access under this Part.

Before making an instrument under subclause (1), the ACCC must consult:

commercial television broadcasting licensees; and

national broadcasters; and

owners and operators of broadcasting transmission towers.

An access seeker must comply with the Code.

The owner or operator of a broadcasting transmission tower must comply with the Code, to the extent to which the Code relates to the provision of access under clause 45 or 46.

The owner or operator of a designated associated facility must comply with the Code, to the extent to which the Code relates to the provision of access under clause 45A.
