18 Application of section 34
(1)
This section applies to a person if:
(a)
the person is a transferred employee; and
(b)
immediately before the person’s transfer time:
(i)
the person was a staff member of CFM; and
(ii)
section 34 of the Commonwealth Funds Management Limited Act 1990 applied in relation to the person.
(2)
Section 34 of the Commonwealth Funds Management Limited Act 1990, as in force immediately before the person’s transfer time, continues to apply, on and after that time, in relation to the person as if the person were a staff member of CFM for so long as the person continues to be employed by a transferred body or a CFM subsidiary.
