18E Person deemed to be criminal lunatic under Removal of Prisoners (Territories) Act 1923

Where a person who has been removed to a State under this Act:

(a)

is found to have been insane at the time of the commission of the offence;

(b)

is found or certified, or otherwise lawfully proved, to be unfit, on the ground of insanity, to be tried for the offence; or

(c)

is convicted of an offence and afterwards certified, or otherwise lawfully proved, to be insane;

the person shall be deemed:

(d)

to be a criminal lunatic within the meaning of the Removal of Prisoners (Territories) Act 1923; and

(e)

to have been removed to that State under that Act;

and sections 9 and 10A of that Act apply (so far as they are capable of applying) in relation to the person accordingly.
