179 Delegation by the Regulator
The Regulator may, in writing, delegate all or any of the Regulator’s functions or powers under this Act to:
a member of the staff of the Regulator; or
an APS employee who holds or performs the duties of an Executive Level 2 position, or an equivalent or higher position, in the Department; or
a person prescribed by the regulations.
Sections 34AA to 34A of the Acts Interpretation Act 1901 contain provisions relating to delegations.
In performing a delegated function or exercising a delegated power, the delegate must comply with any written directions of the Regulator.
Subsection (1) does not apply to a power to make, vary or revoke a legislative instrument.
